Let’s enlighten you with What’s is basically an Administrative Review in the immigration process!
What can one do if they do not feel satisfied with their decision on student visa application (In the case of Refusal or unexpected condition on leaving the UK)? Say for instance; I am very sure that my application was perfect with no information missing, appropriate form filling, and no documents missing, then on what basis my application got refused??? If I have been granted the visas then why did they made such several conditions on leaving?
Sometimes it happens that knowingly or unknowingly there are high chances of assessment error if there is a sheer volume of applications available at the visa application process centers. The officer did not intend to do so, but if any tiny detail is lacking, you may get refusal here. Sometimes it happens that you have been undergone an interview assessment. Where you could be asked few questions, if you have gone through it successfully still you received negative result then you can challenge the decision to the panel for reviewing it. If you feel it is not fair, do not worry at all! You will be given a chance to prove that your profile was genuine and accurate.
Many of you might have heard before on administrative review, this is a process that enables you to request a review or Re-assessment of your visa file. This is mentioned in your Refusal letter if you are applying outside the UK, whether you can do it or not. No matter if you have got refusal more than 4 times, you can still ask the panel to look into it.
If you wish to apply for administrative review on your application from outside the UK, you can do it on your own or ask any professional (immigration lawyer /solicitor) who knows to deal with it. Caution – I would suggest not deal with it personally as there might be many formalities that should be done.
If your solicitor is going to do it on behalf of you, he knows the actual process and where to initiate it.
But in the other case where you are going to apply, you must be aware of the time limit till when you can apply for it. You should start counting the days and decide whether to go for it or not under 28 days after getting the decision. Once you are determined with it, make a request as soon as possible even if you are going to leave the country. If in any trivial circumstances you were not able to do it within the given period, you will have to explain the crucial reason for it. In this case, the right is in the officer’s hand whether he would like to review it or not!
Here is a note to take: prefer the online Review process as post or fax takes longer than usual. You can also go for an oral hearing made by the panel if you wish to.
